A review by the firm of all estates filed in the Montgomery County Probate Court during 2013 reveals that nearly 1 in 3 estates (29%) were filed without a will. These estates, known as “intestate estates,” are administered with close oversight by the probate judge utilizing strict statutory requirements. Administrators of these estates are typically required to provide a bond, comply with burdensome code provisions, and are given very limited discretion over the execution of the estate.
